Personal Information Collection Statement of AI Hub HKT Limited – HKT.AI

This Personal Data Collection Statement (this “Statement”) is issued by AI Hub HKT Limited (“Company”, “we” or “us”) and applies between the Company and you (“You” or the “User”) regarding your use of the AI Services (as defined in the Terms of Use) under the HKT.AI (as defined in the Terms of Use)(the “HKT.AI”), a platform , portal, service, application, interface or other facility made available by the Company to let you to access, explore and interact with various bots powered by our Third Party AI Providers’ AI Models (both as defined in the Terms of Use), operated by the Company in the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”).

This Statement should be read together with the Terms of Use for the HKT.AI issued by the Company (the “Terms of Use”) stated in:

(1) in case of your access is through login with the trusted Identity Provider (including but not limited to the platform named “Google” and “Apple”) (the “IdP”), the pop-up notification box; or

(2) in case of your access is through account creation, the Email Registration Form to create an account (the “User Account”) for use of the HKT.AI (the “Form”) ,

provided that, in the event of any inconsistency between this Statement and the Terms of Use concerning matters relating to personal data, this Statement shall prevail. For the avoidance of doubt, the details of the collection, compilation, retention, use, disclosure and processing of your personal data and any further information about the Offer and/or Services set out in the Privacy Statement of HKT Limited (https://www.hkt.com/en/privacy-statement/for-customers/) (the “HKT Privacy Statement”) shall be incorporated into this Statement in its entirety.

AI Hub HKT Limited is part of or associated with the HKT group of companies including but not limited to itself, Hong Kong Telecommunications (HKT) Limited, CSL Mobile Limited, Now TV Limited, eSmarthealth Limited, Club HKT Limited, HKT CSP Limited, HKT Payment Limited, HKT Financial Services (IA) Limited, HKT Education Limited, The Club Travel Services Limited, HKT Openpay Limited and HKT Advance Limited and their respective affiliated, associated or related companies from time to time (as the case maybe) (the “HKT Group”) (the HKT Group companies and joint venture companies are together referred to as “Affiliates”).

Kinds of personal data collected

The kinds of personal data we may collect from you in the Form and/or from other relevant interface(s), documents, sources or any other means (collectively, the “Channels”) include your email address, nickname, username and password, user ID, mobile number, unique redemption coupon, any other unique identifier or personal identifier provided by us or our relevant Affiliates or the IdP, language preference, credit card and/or electronic/digital payment details, chat style, custom instructions, saved memories and chat history when using the HKT.AI and/or the AI Services, tracking information about your use of the HKT.AI and/or the AI Services and transaction information (including but not limited to transaction data and behaviour of your use of the HKT.AI and/or the AI Service) (“Tracking Data”), analytics data, the relevant User Account metadata, transactional and/or activity records under or relating to your User Account. For Tracking Data collected through the use of cookies and other tracking mechanisms, please also refer to our related policies (including but not limited to the HKT Privacy Statement and Cookies Policy) for further details as to how we collect, use and processing the Tracking Data.

For the avoidance of doubt, if/where applicable, we will indicate which kind of personal data is mandatory or optional for you to provide at the relevant time of data collection, e.g. when you create the User Account.

Purposes for which we use your personal data

The personal data to be collected from you through the Channels will be used and retained by us (and/or our Affiliates) for the following purposes in addition to the purposes as stated under the “How We use Your Data” section in the HKT Privacy Statement (https://www.hkt.com/en/privacy-statement/for-customers/) (collectively, the “Purposes”):

• User Account registration and access management - To create, administer, process, authenticate and manage your User Account, including user registration, login, identity verification, subscription status, access rights, account settings and account security.
• Provision and operation of the HKT.AI - To provide, operate, maintain and support the HKT.AI and/or the AI Services, including enabling you to access, explore and interact with various bots, AI Models, applications, tools, features and related services made available through the HKT.AI by us and/or Third Party AI Providers, and to deal with all matters in connection with your use of the HKT.AI , the User Account and the AI Services.
• Processing of user prompts and interactions - To receive, process, transmit, analyse and respond to your inputs, prompts, queries, messages, uploaded content, files, feedback and other interactions with the HKT.AI and/or the AI Services, including any personal data contained in them (collectively, the “Input Data”) , for the purpose of providing the relevant functions, the Output (as defined in the Terms of Use) and related services.
• Sharing with the Third Party AI Providers and service providers – Where necessary for the provision, operation, support, security, troubleshooting or improvement of the HKT.AI and/or the AI Services, to disclose, transfer, share or transmit the Input Data, account information, usage information and relevant technical information to the Third Party AI Providers, the relevant AI Models, hosting providers, infrastructure providers, payment processors, analytics providers, support providers and other service providers involved in making the HKT.AI and/or the AI Services available to you.
• Personalisation of user experience - Subject to your User Account settings, preferences and applicable consent requirements, to personalize and enhance your experience on the HKT.AI, including by configuring profile and personalisation options, remembering your preferences, recommending AI Models, applications, topics, features, content or services that may be relevant to your use of the HKT.AI and/or the AI Services.
• Subscription, billing and payment administration - To handle and process subscriptions, paid features, billing arrangements, payments, refunds, invoices, coupon redemption and related customer administration, including through third party payment processors and billing service providers.
• Customer support and communications - To respond to your enquiries, requests, complaints and feedback, provide technical support, send service-related notices, and communicate with you regarding your User Account, subscriptions, platform availability, security matters, changes and updates to the HKT.AI and/or the AI Services, and updates to applicable terms or policies or service arrangements, through appropriate communication channels.
• Safety, security and misuse prevention - To monitor, detect, prevent, mitigate, investigate and address fraud, security incidents, unlawful, harmful, abusive, excessive, high risk, insecure or unauthorised use, policy violations, misuse, cyber threat, system vulnerability or operational disruption affecting the HKT.AI and/or the AI Services, and any other conduct that may compromise the safety, integrity, availability or security of the HKT.AI, other users, Third Party AI Providers, service providers or the public.
• Platform analytics and service management and improvement - To conduct data analytics, performance monitoring, debugging, testing, research, service management, maintenance and improvement for the HKT.AI and/or the AI Services, including improving reliability, functionality, user interface, content moderation, safety controls, operational efficiency and service quality.
• Development and improvement of AI-related features - Subject to applicable laws, User Account settings and any required consent, to develop, test, calibrate, evaluate, enhance and improve AI-related functions, features, moderation tools, recommendation systems and platform services, including by using aggregated, anonymised or de-identified data where appropriate.
• Content moderation and compliance enforcement - To review, monitor, moderate, restrict, suspend, disable or remove Content (as defined in the Terms of Use), Input Data, access to features, User Accounts, AI Models, Third Party AI Providers or related services where necessary to enforce the Terms of Use, acceptable use policies, community standards, legal obligations, safety requirements, security requirements or third party provider requirements.
• Legal, regulatory and compliance purposes - To comply with applicable laws, regulations, court orders, regulatory requests, law enforcement requests, contractual obligations, audit requirements, record-keeping obligations, dispute resolution requirements, and to establish, exercise or defend legal rights.
• Business administration and corporate transactions - To administer our business operations, maintain internal records, conduct audits, manage risks, support corporate governance, and facilitate any actual or proposed merger, acquisition, restructuring, transfer of business, financing, due diligence or other corporate transaction.
• Direct Marketing - Subject to consent, to conduct direct marketing as detailed under the “Direct Marketing” section in the HKT Privacy Statement.
• Ancillary purposes - For any purpose directly related to the above purposes, or any other purpose which is notified to you at or before the time of collection or for which your consent is obtained where requiredby applicable laws.

If you do not provide us with the aforementioned required personal data on a voluntary basis, we may not be able to perform the Purposes and/or (subject to your consent) provide relevant Services (as defined in the HKT Privacy Statement) to you.

Persons to whom we may disclose your personal data

Your personal data may be used or maintained by and/or disclosed to, at all times to the extent permitted under applicable Data Protection Laws (as defined in the HKT Privacy Statement), those entities as identified under the “How We Share and Disclose Your Data” section in the HKT Privacy Statement, in particular, the Affiliates, their respective agents (including debt collection agent) and business partners for purposes in connection with the subscription, Offer and/or the Services, including without limitation providing the subscription, Offer and/or the Services to you and enabling your access and retrieval of account information in relation to the subscription, Offer and/or the Services. We may also disclose your personal data to applicable regulatory bodies or governmental authorities for complying with the applicable Data Protection Laws.

Direct Marketing

Subject to your consent, we may use your personal data for the purpose of direct marketing, including without limiting the generality of the details under the “Direct Marketing” section in the HKT Privacy Statement, sending to you notices and/or updates about gifts, discounts, privileged offers, benefits and promotions related to the Offer and/or Services as well as other products and/or services offered by us, members of the HKT Group and/or the Service Providers (as defined in the HKT Privacy Statement), including without limitation: TV, telecommunications, over-the-top (OTT) services, content services, mobile voice, SMS and data communications, IDD/roaming, Internet connectivity, cloud services, electronic/mobile payment, entertainment, secretarial services, personal assistant services and information services (such as weather, finance and news information), device accessories, mobile applications and software, computer peripheral, accessories and software (including notebooks, handsets, mobile devices and accessories, keyboards, security installations and mobile applications), reward, loyalty and privilege programs, lifestyle, networking events, travelling, banking, alcohol, sports, music, gaming, transportation, household products, food and beverages, finance, insurance, asset and wealth management services and products, pensions, investments, brokering, financial advisory, credit and other financial services and products, education, health and wellness, beauty products and services, fashion and accessories, electronics, social networking, technology, e-commerce, digital assets and related offerings and services, logistics, retail, home and décor, media and high-end consumer products and services (collectively, the “Marketing Subjects”).

We cannot use or provide the personal data for directing marketing purposes and/or provide the personal data to any third party (whether to the Affiliates and/or HKT Marketing Partners) for their direct marketing purposes unless you consent. Even if you give your consent, you can opt out of direct marketing at any time (or you may request that AI Hub HKT Limited ceases to provide the personal data to third parties, at which point AI Hub HKT Limited will cease to do so), free of charge, by writing to Group Data Protection Officer (GPO Box 9896 or privacy@pccw.com).

Your Rights

You can find details of your rights under the “Your Rights” section in the HKT Privacy Statement. For the avoidance of doubt, you are also entitled to access, correct or enquire about your personal data being held by us. For any such request, please do so by writing to the Group Data Protection Officer at GPO Box 9896 or via email to privacy@pccw.com. We may impose a reasonable charge on any such request.

Inconsistency or conflict

In case of any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.

Miscellaneous

This Statement may be updated from time to time to reflect changes to the Company’s policy with respect to personal data protection and/or changes to the applicable Data Protection Laws. Where there are significant changes, the Company will notify you and obtain your acceptance of the changes, consents, and/or opt in (as necessary or applicable). If you do not accept the changes and/or provide your consent, then the Company may not be able to perform the Purposes and/or provide the Services to you. You are advised to check the Website portal for updates to this Statement on a regular basis.

Nothing in this Statement shall limit your rights under the Personal Data (Privacy) Ordinance (Chapter 486 of the laws of Hong Kong).

This Statement shall be governed by, and construed in accordance with, the laws of Hong Kong.

• 與第三方人工智慧供應商及服務供應商共用－在為提供、營運、支援、保障安全、排解故障或改善HKT.AI及／或人工智慧服務而有需要的情況下，向第三方人工智慧供應商、相關人工智慧模型、託管供應商、基礎設施供應商、付款處理商、分析供應商、支援供應商及參與向閣下提供HKT.AI及／或人工智慧服務的其他服務供應商披露、轉移、共用或傳送輸入資料、帳戶資料、使用資料及相關技術資料。
• 個人化用戶體驗－在受閣下用戶帳戶設定、偏好及適用同意要求規限下，個人化及提升閣下在HKT.AI上的體驗，包括設定個人資料及個人化選項、記住閣下偏好，以及推薦可能與閣下使用HKT.AI及／或人工智慧服務相關的人工智慧模型、應用程式、主題、功能、內容或服務。
• 訂購、帳單及付款管理－處理及管理訂購、付費功能、帳單安排、付款、退款、發票、優惠券換領及相關客戶行政事宜，包括透過第三方付款處理商及帳單服務供應商處理。
• 客戶支援及通訊－透過適當通訊渠道與閣下溝通，回應閣下的查詢、要求、投訴及意見回饋，提供技術支援，發送服務相關通知，並就閣下的用戶帳戶、訂購、平台可用性、安全事項、HKT.AI及／或人工智慧服務的變更及更新，以及適用條款或政策或服務安排的更新。
• 安全、保安及防止濫用－監察、偵測、防止、緩解、調查及處理影響HKT.AI及／或人工智慧服務的欺詐、保安事故、非法、有害、濫用、過度、高風險、不安全或未獲授權的使用、政策違規、濫用、網絡威脅、系統漏洞或營運中斷，以及任何可能損害HKT.AI、其他用戶、第三方人工智慧供應商、服務供應商或公眾的安全、完整性、可用性或保安的其他行為。
• 平台分析、服務管理及改善－就HKT.AI及／或人工智慧服務進行數據分析、效能監察、除錯、測試、研究、服務管理、維護及改善，包括改善可靠性、功能、用戶介面、內容審核、安全控制、營運效率及服務質素。
• 開發及改善人工智慧相關功能－在受適用法律、用戶帳戶設定及任何所需同意規限下，開發、測試、校準、評估、提升及改善人工智慧相關功能、特點、審核工具、推薦系統及平台服務，包括在適當情況下使用匯總、匿名化或去識別化資料。
• 內容審核及合規執行－在有需要時審查、監察、審核、限制、暫停、停用或移除內容（定義見使用條款）、輸入資料、功能存取、用戶帳戶、人工智慧模型、第三方人工智慧供應商或相關服務，以執行使用條款、可接受使用政策、社群標準、法律責任、安全要求、保安要求或第三方供應商要求。
• 法律、監管及合規目的－遵守適用法律、規例、法院命令、監管要求、執法要求、合約責任、審計要求、紀錄保存責任、爭議解決要求，以及確立、行使或抗辯法律權利。
• 業務行政及公司交易－管理我們的業務營運、保存內部紀錄、進行審計、管理風險、支援公司管治，以及促成任何實際或擬議的合併、收購、重組、業務轉讓、融資、盡職審查或其他公司交易。
• 直接促銷－在取得閣下同意的前提下，進行《香港電訊私隱聲明》中「直接促銷」部分所詳述的直接促銷活動。
• 輔助目的－用於與上述用途直接相關的任何目的，或於收集時或之前通知閣下的任何其他目的，或在適用法律要求下取得閣下同意的任何其他目的。

我們可能向其披露閣下個人資料的人士

AI Hub HKT Limited 是香港电讯集团公司之旗下公司或联营公司，包括但不限于其本身、Hong Kong Telecommunications (HKT) Limited、香港移动通讯有限公司、Now TV Limited, 益体健有限公司、Club HKT Limited、HKT CSP Limited、HKT Payment Limited、HKT Financial Services (IA) Limited、HKT Education Limited、The Club Travel Services Limited、HKT Openpay Limited 及 HKT Advance Limited以及彼等各自不时之联属、联营或关连公司（视情况而定）（「香港电讯集团」）（香港电讯集团公司和合资公司统称为「联属公司」）。

收集的个人资料类型

我们可能透过登记表格及／或从其他相关介面、文件、来源或任何其他途径（统称「本渠道」）向阁下收集的个人资料种类包括：阁下的电子邮件地址、暱称、用户名称及密码、用户编号 、手机号码、独家兑换券、由我们或我们的相关联属公司或 IdP 提供的任何其他唯一识别码或个人识别码、语言偏好、信用卡及／或电子／数位支付详情、对话风格、自订指令、使用 HKT.AI 及／或 人工智慧 服务时的储存记忆与聊天记录、关于您使用 HKT.AI 及／或 人工智慧 服务的追踪资讯以及交易资讯（包括但不限于交易数据及您使用 HKT.AI 及／或 人工智慧 服务的行为）（「追踪数据」）、分析数据、相关的用户帐户元数据、以及您用户帐户项下或与之相关的交易及／或活动记录。对于透过使用 Cookies 和其他追踪机制收集的追踪数据，请参阅我们的相关政策（包括但不限于《HKT 隐私声明》及《Cookies 政策》），以了解关于我们如何收集、使用和处理追踪数据的更多详情。

为免生疑，如适用，我们将于收集资料时（例如当阁下建立用户帐户时）标明哪些个人资料属必须提供或可选提供。

我们使用阁下个人资料的用途

我们将（和/或我们的关联公司）透过渠道向阁下收集的个人资料除作《香港电讯私隐声明》（https://www.hkt.com/en/privacy-statement/for-customers/）「我们如何使用阁下的个人资料」一节所述用途外，亦会使用并保留于以下用途（统称「用途」）：

• 用户帐户登记及存取管理－建立、管理、处理、认证及管理阁下的用户帐户，包括用户登记、登入、身分核实、订购状态、存取权限、帐户设定及帐户安全。
• 提供及营运HKT.AI－提供、营运、维护及支援HKT.AI及／或人工智慧服务，包括让阁下存取、探索及与由我们及／或第三方人工智慧供应商提供的各类机械人、人工智慧模型、应用程式、工具、功能及相关服务互动，并处理与阁下使用HKT.AI、用户帐户及人工智慧服务相关的一切事宜。
• 处理用户提示及互动－接收、处理、传送、分析及回应阁下向HKT.AI及／或人工智慧服务输入的内容、提示、查询、讯息、上载内容、档案、意见回馈及其他互动（包括其中所包含的任何个人资料）（统称「输入资料」），以提供相关功能、输出（定义见使用条款）及相关服务。
• 与第三方人工智慧供应商及服务供应商共用－在为提供、营运、支援、保障安全、排解故障或改善HKT.AI及／或人工智慧服务而有需要的情况下，向第三方人工智慧供应商、相关人工智慧模型、托管供应商、基础设施供应商、付款处理商、分析供应商、支援供应商及参与向阁下提供HKT.AI及／或人工智慧服务的其他服务供应商披露、转移、共用或传送输入资料、帐户资料、使用资料及相关技术资料。
• 个人化用户体验－在受阁下用户帐户设定、偏好及适用同意要求规限下，个人化及提升阁下在HKT.AI上的体验，包括设定个人资料及个人化选项、记住阁下偏好，以及推荐可能与阁下使用HKT.AI及／或人工智慧服务相关的人工智慧模型、应用程式、主题、功能、内容或服务。
• 订购、帐单及付款管理－处理及管理订购、付费功能、帐单安排、付款、退款、发票、优惠券换领及相关客户行政事宜，包括透过第三方付款处理商及帐单服务供应商处理。
• 客户支援及通讯－透过适当通讯渠道与阁下沟通，回应阁下的查询、要求、投诉及意见回馈，提供技术支援，发送服务相关通知，并就阁下的用户帐户、订购、平台可用性、安全事项、HKT.AI及／或人工智慧服务的变更及更新，以及适用条款或政策或服务安排的更新。
• 安全、保安及防止滥用－监察、侦测、防止、缓解、调查及处理影响HKT.AI及／或人工智慧服务的欺诈、保安事故、非法、有害、滥用、过度、高风险、不安全或未获授权的使用、政策违规、滥用、网络威胁、系统漏洞或营运中断，以及任何可能损害HKT.AI、其他用户、第三方人工智慧供应商、服务供应商或公众的安全、完整性、可用性或保安的其他行为。
• 平台分析、服务管理及改善－就HKT.AI及／或人工智慧服务进行数据分析、效能监察、除错、测试、研究、服务管理、维护及改善，包括改善可靠性、功能、用户介面、内容审核、安全控制、营运效率及服务质素。
• 开发及改善人工智慧相关功能－在受适用法律、用户帐户设定及任何所需同意规限下，开发、测试、校准、评估、提升及改善人工智慧相关功能、特点、审核工具、推荐系统及平台服务，包括在适当情况下使用汇总、匿名化或去识别化资料。
• 内容审核及合规执行－在有需要时审查、监察、审核、限制、暂停、停用或移除内容（定义见使用条款）、输入资料、功能存取、用户帐户、人工智慧模型、第三方人工智慧供应商或相关服务，以执行使用条款、可接受使用政策、社群标准、法律责任、安全要求、保安要求或第三方供应商要求。
• 法律、监管及合规目的－遵守适用法律、规例、法院命令、监管要求、执法要求、合约责任、审计要求、纪录保存责任、争议解决要求，以及确立、行使或抗辩法律权利。
• 业务行政及公司交易－管理我们的业务营运、保存内部纪录、进行审计、管理风险、支援公司管治，以及促成任何实际或拟议的合并、收购、重组、业务转让、融资、尽职审查或其他公司交易。
• 直接促销－在取得阁下同意的前提下，进行《香港电讯私隐声明》中「直接促销」部分所详述的直接促销活动。
• 辅助目的－用于与上述用途直接相关的任何目的，或于收集时或之前通知阁下的任何其他目的，或在适用法律要求下取得阁下同意的任何其他目的。

若阁下未自愿提供上述所需个人资料，我们可能无法履行用途及/或（在取得阁下同意的情况下）向阁下提供相关服务（定义见《香港电讯私隐声明》）。

我们可能向其披露阁下个人资料的人士

在适用之资料保护法规（定义见《香港电讯私隐声明》）许可范围内，阁下的个人资料可随时由《香港电讯私隐声明》「我们如何共用和披露阁下的个人资料」一节所识别之该等实体使用或保存及／或向其披露，特别是联属公司、彼等各自之代理（包括债务催收代理）及业务伙伴，用于与订购、优惠及／或服务相关之目的，包括但不限于向阁下提供订购、优惠及／或服务以及使阁下得以存取及检索与订购、优惠及／或服务相关之帐户资讯。我们亦可能为遵守适用之资料保护法规向相关监管机构或政府机关披露阁下的个人资料。

直接促销

在取得阁下同意的情况下，我们可能会将阁下的个人资料用于直接促销目的，包括（在不限制《香港电讯私隐声明》「直接促销」一节所述详情之一般性原则的情况下）向阁下发出与优惠及／或服务以及我们、香港电讯集团成员公司及／或服务供应商（定义见《香港电讯私隐声明》）所提供之其他产品及／或服务有关的礼品、折扣、尊享优惠、优惠和推广的通知及／或最新情报，包括但不限于：电视、电信、OTT服务、内容服务、流动话音、短讯及数据通讯、IDD／国际漫游、互联网连接、云端服务、电子／手机付款、娱乐、秘书服务、个人助理服务和资讯服务（例如天气、财经和新闻资讯）、装置配件、流动应用程式和软件、电脑周边产品、配件和软件（包括手提电脑、手提电话、流动装置及配件、键盘、保安装置及流动应用程式）、奖赏、忠诚或尊贵计划、生活方式、社交活动、旅游、银行、酒精、运动、音乐、游戏、交通、家居产品、餐饮、金融、保险、资产及财富管理服务及产品、退休金、投资、经纪服务、理财顾问、信贷及其他理财服务和产品、教育、健康及保健、美容产品和服务、时装及配饰、电子产品、社交网络、科技、电子商务、数码资产及相关产品和服务、物流、零售、家居布置、媒体及高端消费类产品及服务（统称「营销主题」）。

除非阁下同意，否则我们不得使用或提供个人资料作直接促销用途，及／或将个人资料提供予任何第三方（不论是联属公司及／或香港电讯营销伙伴）作其直接促销用途。即使已取得阁下同意，阁下仍可随时免费选择退出直接促销（或要求AI Hub HKT Limited 停止向第三方提供个人资料，届时AI Hub HKT Limited 将立即停止），请以书面形式致函集团资料保障主任（香港邮政总局信箱9896号或电邮privacy@pccw.com）。

阁下的权利

阁下可于《香港电讯私隐声明》「阁下的权利」一节查阅阁下的权利详情。为免生疑，阁下亦有权查阅、修正或查询我们所持有的阁下的个人资料。如欲提出任何有关要求，请以书面形式致函集团资料保障主任，香港邮政总局信箱9896号或电邮至privacy@pccw.com。我们可因应任何有关要求收取合理费用。

歧义或冲突

若中、英文版本有歧义之处，概以英文版本为准。

其他

本声明可能不时更新以反映本公司在个人资料保护方面的政策变更及／或资料保护法规的变更。若涉及重大变更，本公司将通知阁下并取得阁下对变更的接受、同意及／或选择加入（视乎需要或适用情况）。若阁下不接受变更及／或表示同意，则本公司可能无法履行用途及／或向阁下提供服务。务请阁下定期查阅本网站以了解本声明之更新情况。

本声明之任何内容均不得限制阁下根据《个人资料（私隐）条例》(香港法例第486章）所享有的权利。

本声明受香港法例规管并据此诠释。
